Abstract As the reform of education system advancing, the teacher has spun off the original "national cadre" team and became a specialized occupation, but the legal status of teachers is still not clear. The legal status of teachers is very important. The legal position will involve the teacher attributes, and the legal relationship between teachers and the government, schools and teachers，teachers and students. This paper will take basic education and higher education teachers as an example, the legal status is analyzed, and puts forward some suggestions on how to protect the legal rights and interests of teachers.
